Agreement

Welcome to Best-Exchanger. These Terms of Service ("Terms", "Agreement") constitute a legally binding contract between the operator of the Best-Exchanger platform ("Service", "We", "Us") and any individual or legal entity utilizing our digital asset exchange infrastructure ("User", "You"). By accessing our platform, registering an account, or initializing an exchange transaction, you acknowledge that you have read, understood, and agreed to be bound by the entirety of these Terms.


1. Eligibility and User Representation


* By executing transactions on Best-Exchanger, you declare and warrant that you are at least 18 years of age (or the legal age of majority in your jurisdiction) and possess full legal capacity to enter into binding agreements.
* You certify that you are not a citizen, resident, or under the legal jurisdiction of any country subject to comprehensive international financial sanctions or embargoes.
* You represent that all digital assets, fiat currencies, or credentials provided during the exchange process belong to you exclusively, are free from third-party liens, and are derived from entirely legitimate, lawful origins.

2. Description of Services


* Best-Exchanger provides non-custodial automated and semi-automated technical infrastructure designed for the exchange of digital currencies, stablecoins, and fiat payment methods.
* An exchange operation is initialized exclusively by the User generating an electronic order request through the interface of the platform.
* The Service executes exchange orders based on the specific numerical rates, network fee allocations, and parameters explicitly displayed to the User at the precise moment the order is locked and finalized.

3. Order Processing and Transaction Rate Fixing


* Cryptocurrency exchange rates are subject to continuous, high-velocity market volatility. The transaction rate is fixed only when the Service receives the required number of blockchain network confirmations for the incoming deposit, unless a distinct rate-fixing mechanism is specified for a particular payment route.
* The User acknowledges that network processing delays (blockchain congestion) may result in automatic re-calculations of the final payout amount to reflect the live market conditions at the exact second of actual deposit confirmation.
* If an incoming deposit is received after the designated order lifetime expiration window, the Service reserves the right to cancel the order and place the assets into a return queue, or execute the exchange using the current live market rate.

4. Financial Obligations and Network Fees


* The User is entirely responsible for covering all external expenses associated with their transaction, including but not limited to blockchain network gas fees (Network Fees), third-party banking transfer tariffs, processing intermediary commissions, and conversion surcharges.
* Best-Exchanger embeds its operational processing fee directly into the displayed conversion matrix. The payout amount visible on your order confirmation page is the exact net value to be dispatched, subject to normal network validation parameters.
* Any errors in payment destinations, mistyped wallet addresses, or mismatched contract specifications entered by the User during order generation are the sole financial responsibility of the User. The Service cannot reverse blockchain transactions once dispatched.

5. Anti-Money Laundering (AML) and Transaction Holds


* Best-Exchanger operates a strict zero-tolerance risk management framework. Every inbound and outbound digital asset routing undergoes mandatory, automated cryptographic compliance screening through our partner ecosystem, including BitOK analytical nodes.
* As detailed in our separate AML/KYC Policy, if an incoming transaction triggers elevated structural alerts (e.g., direct association with darknet hubs, mixers, sanction vectors, or ransomware wallets), the Service will immediately suspend execution of the order.
* Suspended orders require the User to complete full Identity Verification (KYC) and provide valid documentation demonstrating the legal Source of Funds (SoF). Funds will remain securely locked until the compliance department reaches a formal determination.

6. Refund Framework and Penalties


* Refunds for cancelled, unpaid, or high-risk transactions are subject to mandatory operational deductions to prevent platform abuse and cover manual administrative overhead.
* If a transaction is rejected due to critical AML risk scoring or direct connection to malicious actors, a **5% penalty fee (capped at a maximum equivalent of 100 USD)** is applied to cover the technical costs of toxic asset management and security audits.
* For deposits originating from un-licensed gambling entities or illicit shadow casinos, a **5% processing deduction** is levied.
* Standard refunds for safe, compliant operations cancelled due to timing constraints or User requests are processed promptly, with deductions limited exclusively to the actual blockchain network delivery fees.

7. Prohibited Platform Activities


Users are strictly prohibited from engaging in the following actions while utilizing our interface or infrastructure:
* Deploying automated scripts, bots, scrapers, or structural reverse-engineering exploits to manipulate the order execution system or extract pricing data arbitrarily;
* Initiating multiple artificial split transactions ("smurfing") intended to deliberately evade the platform's automated AML risk-threshold triggers;
* Utilizing the platform to process funds linked to cyber extortion, deceptive financial engineering schemes, or prohibited dark market marketplaces;
* Uploading fraudulent, doctored, or stolen identity credentials during required compliance audits.

8. Limitation of Liability and Force Majeure


* Best-Exchanger provides its services on an "as-is" and "as-available" baseline, without warranties of any kind, whether express, implied, or statutory.
* The Service shall not be held financially or legally liable for losses, damages, or operational interruptions resulting from sudden global blockchain forks, smart contract exploits, severe network-wide protocol upgrades, unexpected government restrictions, or localized internet routing failures.
* Under no circumstances shall the maximum aggregate liability of Best-Exchanger for any single customer claim exceed the total operational fee retained by the platform for that specific transaction.

9. Intellectual Property Protection


* All digital assets, source code structures, UI/UX designs, trademarks, logos, and structural textual contents displayed across the platform are the exclusive intellectual property of Best-Exchanger.
* Unauthorized copying, framing, scraping, mirror site deployment, or commercial reuse of these technical materials without explicit written authorization from our management core is strictly prohibited.

10. Data Governance and Confidentiality


* Any personal identifiers, contact metadata, or cryptographic validation histories collected during your transaction lifecycles are processed under high-security safeguards in full compliance with our Privacy Policy.
* We enforce end-to-end data isolation across encrypted database clusters to protect your operational metrics from leakages or external exploitation vectors.

11. Dispute Resolution and Applicable Law


* Any disputes, claims, or disagreements arising out of or relating to these Terms shall be resolved initially through direct, amicable negotiations with our specialized customer support and compliance departments.
* If a mutual agreement cannot be reached within 30 business days, the dispute shall be governed by and construed in accordance with the laws of the jurisdiction where our infrastructure operating entity is legally registered, without regard to conflict of law principles.

12. Policy Revisions and Final Provisions


* Best-Exchanger retains the absolute right to amend, update, or re-structure these Terms of Service at its sole discretion to accommodate updates in server architecture, market conditions, or global regulatory changes.
* The revised Terms become legally active the exact moment they are uploaded to the platform's interface. Your continued usage of our exchange services after a document refresh serves as explicit, binding validation of the new terms.
